What to Do if a Vehicle is Pulled Over for Emergency Stop

Last month, a tow truck driver was struck and killed along I-10 near Cabazon. According to the California Highway Patrol (CHP), the tow truck was pulled over and the emergency lights were on. Despite taking these precautions, the tow truck driver was fatally struck by a big rig that drifted onto the shoulder. The devastating crash is an important reminder for drivers to respond appropriately when a vehicle is pulled over for an emergency stop.

“Move Over or Slow Down”

California has a law in place known as the “Move Over or Slow Down” law. This law requires that motorists change lanes—or, if that is not possible, to slow down to a safe speed—if an emergency vehicle or tow truck is pulled over with the lights flashing. It was specifically created to protect first responders and other workers who have pulled over and may be outside their vehicles. Drivers can be fined for failing to take appropriate precautions in these instances.

The law applies for emergency vehicles, tow trucks and Caltrans vehicles, but it is important practice any time you are driving and see a vehicle pulled over.
