But is the average citizen able to get into court? Several court cases in the past decade have made this a much more difficult task. In AT&T Mobility v. Concepcion, the U.S. Supreme Court made it much easier for corporations to use form contracts to bar customers from court to stop unscrupulous charges. The effect will be that no individual lawsuits will be filed because the amount involved is too small.

In the Walmart v. Dukes case, the five member majority essentially precluded employees from getting to court in a discrimination claim, making it unlikely for corporations to be held accountable.

Perhaps the most troubling is the Pliva v. Mensing case, which bars suits against generic drug manufacturers for failing to warn consumers of their drug’s dangers. Now 90% of patients use generic drugs and there is no incentive on the part of the manufacturers to warn of danger.

Really unfair: Connick v. Thompson. Prosecutors hid key evidence and convicted an innocent man of murder. Though the man spent 18 years in prison, the court ruled he couldn’t sue the prosecutors.
