Johnson & Johnson Settles Deceptive Marketing Claims for $120 Million

Johnson & Johnson and its subsidiary DePuy Orthopaedics have agreed to a $120 million settlement over deceptive marketing claims regarding hip implants. The lawsuit was brought by 46 states, claiming that the companies had made misleading claims about metal-on-metal hip implants.

In 2010, DePuy recalled 93,000 ASR hip implant systems due to high failure rates. Then in 2013, the company stopped selling Pinnacle hip implant systems. DePuy is currently facing more than 10,000 lawsuits over its Pinnacle hip implants.

While J&J and DePuy are settling the claim, the companies have said they do not admit liability or misconduct in regard to the states’ allegations.
