Insys Accused of Bribing Doctors to Prescribe Opioids

The U.S. Department of Justice, along with six states, has brought whistleblower litigation against Insys Therapeutics, the maker of Fentanyl-based drug Subsys. The filing alleges that Insys paid doctors kickbacks for prescribing the company’s opioid medications to patients.

Subsys is an under-the-tongue spray, which is approved for pain management in cancer patients who are already receiving opioid therapy. However, one former sales representative involved in the litigation claims that doctors prescribed the strong drug for off-label uses, such as back pain. Additionally, the government has accused Insys of offering “sham” speaking fees and extravagant meals to entice doctors to prescribe Subsys.

Insys Executives Face Criminal Charges

Insys currently faces a criminal investigation into its practices, including the marketing of Subsys and the actions of former executives and sales representatives. Federal prosecutors have accused Insys founder John Kapoor and other Insys employees of scheming to bribe doctors and defraud insurers.
