Accident Victim Gets New Disc and $958,000

A drowsy driver on bipolar medication blows a red light, sending a 19-year-old woman to the ER to get a cut chin stitched. But after more than 3 years of treatment after the accident, the victim still has constant neck pain.

Thanks to advances in medicine, an artificial disc was implanted to replace the woman’s disc, which was damaged in the collision. The new device allows her to turn her head more easily than if she would have undergone a traditional intervertebral fusion.

Though the man-made part, like prosthetic knees and hips, probably won’t last forever, the pain relief is a major benefit. However, the insurance company said that the doctors overcharged, and the young lady wasn’t really affected by the ordeal because she’d returned to work soon after the crash. Fortunately, the jury awarded $767,499 on August 26, 2010, and the young lady received $958,433 inclusive of interest and costs.

Juries Are Not Always So Understanding

Other less understanding juries awarded $3,206 to the victim of a rear-end collision. The jury felt like the shoulder injury (which did not get noted in the medical records for several months) wasn’t related to the collision. And a woman who tripped on a raised sidewalk, breaking her knee cap and elbow, received nothing after having been offered $50,000.
