E-Cigarettes Now Subject to FDA Regulation

E-cigarettes will now be under FDA regulation, along with other tobacco products including hookahs, cigars and pipe tobacco. The decision was announced on the heels of dozens of reports of e-cigarettes causing injuries.

Last month, an Orange County man lost his left eye after his e-cigarette exploded and shot debris at his head. Joe Cavins suffered smashed sinus bones and shrapnel to his eyeball after the battery in his e-cigarette blew up next to him in his Irvine home office on April 15.

The new regulations will require oversight of the nicotine that goes into the e-cigarettes and regulation of some of the batteries used in the devices. It will also force manufacturers to show what ingredients are used in their products and to use child-resistant packaging to protect children from poisoning themselves. According to the CDC, there has been a significant increase in calls to poison control centers due to young children ingesting the e-cigarette liquid or getting it in their eyes or on their skin.

While the FDA regulations will be an improvement to what has for years been a largely unregulated industry, Cavins believes there is a larger problem being overlooked. The manufacturing of the components used in e-cigarettes will not be regulated under the new law, and Cavins believes this leaves a gap in ensuring the safety of the devices.
