Couple Sues Johnson & Johnson for Defective Physiomesh

A Tennessee couple is suing Ethicon and its parent company Johnson & Johnson for injuries the wife sustained after being implanted with its physiomesh. The lawsuit, which was filed in New Jersey, seeks compensatory and punitive damages for the plaintiff’s injuries.

The lawsuit states that the plaintiff underwent surgery to repair a hernia in September of 2012. Doctors used an Ethicon physiomesh device to complete the repair. However, complications with the physiomesh caused the plaintiff to need a second surgery to have it removed. Doctors noted during the removal in July of 2014 that the physiomesh had weakened and thinned, and that there were recurrent herniations around the area where the repair had been done. Because the mesh had deteriorated so badly, the plaintiff had to undergo a third surgery to have all of it removed.

As a result of the physiomesh failure, the plaintiff continues to suffer from a variety of symptoms, including severe pain, bloating, diarrhea and constipation. Because of all the surgeries she’s had, she is now at risk for severe complications if she requires any more abdominal surgeries.

According to the lawsuit, Ethicon and its parent company failed to provide adequate warnings about the dangers of its physiomesh product. Ethicon finally recalled the physiomesh in May of 2016, but by then it was far too late for the plaintiff.

“The plaintiff in this case has suffered repeatedly because of this defective product,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
