Two people were injured in a New Year’s Eve crash on Tomahawk Road in Apple Valley. A Dodge Ram heading east on Tomahawk Road collided with a BMW 5 Series pulling out of a driveway around 11:30 a.m.

Both drivers were taken to the hospital for moderate injuries. According to the homeowner, the BMW driver is his brother who was visiting from Upland.

Tomahawk Road was closed down for about two hours for the cleanup and investigation. The Apple Valley Police Department is investigating the New Year’s Eve crash.

It can be difficult to determine fault in a crash like this. Although the BMW was rear-ended—usually a sign that the other driver is at fault—drivers traveling on the roadway have the right of way versus those pulling out of driveways or shopping centers to get onto the main road.

“We hope both drivers recover quickly. It’s important to be patient and wait until the coast is clear before pulling out from a driveway onto the road,” said Attorney Walter Clark, founder of Walter Clark Legal Group.
