Johnson & Johnson Faces New Vaginal Mesh Lawsuits

More vaginal mesh lawsuits are coming Johnson & Johnson’s way this week. California and Washington state are suing the company for misrepresenting the risks of its vaginal mesh implants.

The plastic mesh devices are used to treat urinary incontinence and pelvic organ prolapse, a condition that sometimes occurs after childbirth, hysterectomy or menopause in which organs like the bladder, bowel and uterus shift. The lawsuits allege Johnson & Johnson failed to inform patients and doctors of the serious health risks and potential irreversible complications associated with the implants. These risks include urinary dysfunction, loss of sexual function, severe pain and constipation.

The FDA changed the product risk from moderate to high risk earlier this year after receiving reports of thousands of injuries and determining women are more likely to have complications from mesh than from traditional surgery.

While California’s vaginal mesh lawsuit claims Johnson & Johnson practiced deceptive marketing, Washington state’s suit alleges the company violated the state’s consumer protection law. Washington Attorney General Bob Ferguson claims the company sold thousands of devices in Washington and failed to warn patients of serious complications. Apparently the body can reject the mesh, which can cause chronic inflammation. The implants can also harbor infections and can even protrude into an organ or through the vaginal wall.
