Dole Faces Wrongful Death Lawsuit for Listeria Death

Dole food company faces a wrongful death lawsuit for the death of an Ohio woman who died from an infection caused by listeria, which she allegedly contracted from a Dole packaged salad. Ellen DiStefano became ill January 17 from the salad, which was packaged at the company’s Springfield plant. DiStefano was hospitalized for the infection and died on February 27.

The Springfield plant shut down in January after the salad products produced there were linked to a listeria outbreak that hospitalized 12 people in six states and killed one person in Michigan.

The wrongful death suit alleges that Dole failed to prevent the contamination of its food products, and that the company acted with negligence once it discovered listeria was in its facility.

Listeria is most dangerous for seniors, pregnant women and individuals with a weak immune system. Symptoms of the illness, known as listeriosis, include muscle aches, fever, and gastrointestinal problems. It can also get into the central nervous system and cause confusion, loss of balance and convulsions. If you experience any of these symptoms and think you may have been exposed to listeria, seek medical attention immediately, as prolonged illness can be fatal.

A full list of products affected by the outbreak can be found at the CDC website.

“Be sure to check the website to make sure you’re not consuming tainted products, and throw them way if you have them,” said Attorney Walter Clark, founder of Walter Clark Legal Group. “If you’re worried you’ve been infected with listeria, the best thing to do is see your doctor as soon as possible.”
